Of all the low down things that someone can do, discriminating against a disabled person is one of the worst offenses.

An AMC theater manager was caught on video telling police to remove a disabled child from the theater because she wasn’t wearing a mask.

This dirtbag actually had the entire family removed. Take a look:

I agree with the police officer and applaud him for sticking to his guns. He is doing exactly what he should be doing and seems to understand the law and the jurisdiction of this incident and realizes that this is not a matter that he can enforce.

Like the officer said, as a private business they have the right to refuse service to anyone they choose. It may be against federal law and there may be a lawsuit that comes from it, but that’s his right to do so.

But just because he can refuse service, doesn’t mean it is wise or a good thing and it is likely that your business will suffer because of it, which actually seems to be the case because following this incident there was a protest arranged at the theater and they’re encouraging people to not visit this theater.

According to WNCT,

On December 27 at approximately 12:44 p.m., Jacksonville Police Department responded to the AMC movie theater on Western Boulevard regarding a protest.

The initial investigation revealed that several individuals had gathered in the lobby of the theater to protest the fact that a patron was being requested to wear a face-covering per the AMC Corporate policy. The complaint alleged that a guest was being discriminated against due to a medical condition covered under the American with Disabilities Act (ADA).

Officers said they spoke to all parties concerned and determined that the incident occurred on private property and that AMC had requested the guests leave the property who were not complying with AMC’s policy regarding face coverings, which AMC indicated was to comply with the requirements of the Governor’s Executive Order regarding face coverings.

There were no arrests or charges levied in this incident, and all protestors left the business on their own accord.

JPD said, “Whether there was a violation of the Americans with Disabilities Act, is a civil matter that must be resolved through a civil action, if necessary. Jacksonville Police Department’s role was to keep the peace and investigate the possibility of trespassing on private property.”

While AMC said they were complying with the Governor’s order, they really weren’t because it states the following:

Exceptions. This Executive Order does not require Face Coverings for-and a Face Covering does not need to be worn by a worker or Guest who:

a. Should not wear a Face Covering due to any medical or behavioral condition or disability (including, but not limited to, any person who has trouble breathing, or is unconscious or incapacitated, or is otherwise unable to put on or remove the Face Covering without assistance);

…..

j. Is a child whose parent, guardian, or responsible person has been unable to place the Face Covering safely on the child’s face. Anyone who declines to wear a Face Covering for these reasons should not be required to produce documentation or any other proof of a condition.

So clearly, they are breaking one or both of those exceptions by doing what they did.
