A recent ruling in Colorado has dismissed an attempt to disqualify former President Trump from the state’s 2024 presidential primary ballot under the 14th Amendment. This decision was handed down by Colorado Judge Sarah B. Wallace. The lawsuit was lodged by Citizens for Responsibility and Ethics in Washington on behalf of six Colorado voters..yes, six voters.
Judge Wallace ruled that the insurrection clause of the 14th Amendment, which was the basis for the challenge, does not apply to the presidency. The judge expressed her hesitation to endorse an interpretation that would disqualify a presidential candidate without a clear, unmistakable indication that such is the intent of Section 3.
This comes on the heels of similar efforts to bar Trump from appearing on state ballots in Michigan and Minnesota, both of which have also failed. Steven Cheung, a Trump campaign spokesperson, lauded the ruling as another setback for attempts to declare Trump ineligible to run for office.
Cheung said, “We applaud today’s ruling in Colorado, which is another nail in the coffin of the un-American ballot challenges,” He added, “These cases represent the most cynical and blatant political attempts to interfere with the upcoming presidential election by desperate Democrats who know Crooked Joe Biden is a failed president on the fast track to defeat.”
However, Judge Wallace did rule that the Capitol riot was an “insurrection” and claimed that Trump intended to “incite political violence.” She wrote, “Trump acted with the specific intent to incite political violence and direct it at the Capitol with the purpose of disrupting the electoral certification,” and added, “Trump cultivated a culture that embraced political violence through his consistent endorsement of the same.”
Mario Nicolais, a lawyer for the group that challenged Trump’s eligibility, stated that they planned to appeal the decision. The group believes that Section 3 of the 14th Amendment does apply to presidents who engage in insurrection.
Despite these ongoing legal battles, Trump remains the frontrunner for the 2024 Republican nomination, as recent polls from key swing states show him leading Joe Biden. The ruling from Judge Wallace coincided with an announcement from House Speaker Mike Johnson that footage from the January 6 incident would be made publicly available.
This ruling is a significant victory for Trump and his supporters. It sends a clear message that attempts to use the 14th Amendment to disqualify him from running for president are unlikely to succeed.
