Merchan Issues Ruling On Trump Gag Order
There has been a huge development surrounding former President Trump and the gag order that’s been causing quite a stir. Judge Juan Merchan has partially lifted the gag order he placed on Trump, a move that comes just weeks after a jury found Trump guilty on all counts in his recent trial.
Now, Trump and his legal team have been fighting this gag order since it was first imposed. They ramped up their efforts to have it lifted, especially before the upcoming June 27 presidential debate. This gag order initially barred Trump from making or directing public statements about witnesses, the case’s counsel (except Manhattan District Attorney Alvin Bragg), court staff, DA staff, or their families.
But on Tuesday, Judge Merchan decided to ease up a bit. He partially lifted the gag order now that the trial is over. This means Trump can talk about protected witnesses and jurors. However, he still can’t comment on individual prosecutors, court staff, or their families. That part of the order stays in place until Trump’s sentencing on July 11.
In his order, reviewed by Fox News, Judge Merchan explained that the gag order was initially set to protect the integrity of the judicial proceedings. With the trial wrapped up and the jury discharged, he felt it was appropriate to make some changes. Despite Trump’s appeal to lift the gag order entirely, which was rejected, Merchan noted that the court can’t extend all protections indefinitely based on the changed circumstances.
Interestingly, this partial lifting of the gag order happened shortly after the New York Court of Appeals turned down Trump’s bid to have it completely removed. The court stated that there was “no substantial constitutional question directly involved.”
Trump, the presumptive Republican presidential nominee, was found guilty on 34 counts of falsifying business records in the first degree last month. These charges were brought by DA Alvin Bragg and led to a six-week trial. Trump’s defense has argued that the gag order violates his First Amendment rights and those of his supporters.
Steven Cheung, a spokesperson for Trump’s campaign, criticized the decision, calling it unconstitutional and accusing Judge Merchan of having conflicts of interest. Cheung stated, “This is another unlawful decision by a highly conflicted judge, which is blatantly un-American as it gags President Trump, the leading candidate in the 2024 Presidential Election during the upcoming Presidential Debate on Thursday.”
Trump’s sentencing is set for July 11, just a few days before the Republican National Convention in Milwaukee, where he’s expected to be formally nominated as the 2024 Republican presidential candidate.
