House Republicans Sue For Access To Audio Tapes

The interview in question took place at the beginning of the year, and the recordings of the discussion remained confidential due to the Biden administration invoking executive privilege. The focus of this interview was President Biden’s handling of classified documents. The filed lawsuit argues that the use of executive privilege in this scenario is “frivolous.” This is because the committee believes the audio of the interviews could shed light on the Justice Department’s investigation into Biden’s document handling.
To provide a direct quote from the lawsuit, “The Committee thus needs those recordings to assess the Special Counsel’s characterization of the President, which he and White House lawyers have forcefully disputed, and ultimate recommendation that President Biden should not be prosecuted”.

In the report, Hur states a jury would likely perceive Biden, who is now 81 years old, as “a sympathetic, well-meaning, elderly man with a poor memory.” As a result, the House Judiciary Committee has requested that the U.S. District Court in Washington, D.C., dismiss Biden’s executive privilege claim and instruct Garland to release the audio recordings. The committee believes that these tapes will offer key verbal and nonverbal context not available in the written transcripts of the interview.
According to the lawsuit filed by the Judiciary Committee, “That verbal and nonverbal context is quite important here because the Special Counsel relied on the way that President Biden presented himself during their interview — ‘as a sympathetic, well-meaning, elderly man with a poor memory’ — when ultimately recommending that President Biden should not be prosecuted for unlawfully retaining and disclosing classified information”.
