Democrats Call Nancy Pelosi and Chuck Schumer to Strip Supreme Court of Jurisdiction
Democrats are fighting tooth and nail to preserve the right to slaughter the innocent. Now, people like AOC is calling on Nancy Pelosi and Chuck Schumer to strip the Supreme Court of their jurisdiction to weigh in on matters related to abortion.
“Congress is granted the authority to remove the Supreme Court’s jurisdiction under Article III,” Democratic New York Rep. Alexandria Ocasio-Cortez said on Thursday. “To protect marriage equality, contraception, and more, we need to limit the power of the far-right Court that’s already overturned Roe v. Wade.”
With our basic rights under threat from a rogue Supreme Court, Congress needs to exercise our legal authority to the fullest extent. That's why today we called on @SenSchumer and @SpeakerPelosi to support stripping the Supreme Court’s jurisdiction over abortion. pic.twitter.com/9Rp6RkEqs8

Is this true? Can Congress really do this to the Supreme Court?
Well, it’s hard to say. Article 3, Section 2.2 of the Constitution states:
In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.
I think what this would require is whether or not would fall into the category of cases that are not part of those mentioned earlier in the section and what limits Congress can actually impose to remain consistent with that definition. In my opinion, they don’t have a chance because the way I see it, based on this section, they can only enact limitations regarding Ambassadors and other public ministers and consuls and those in which a state shall be a party.
But does paragraph one also apply? Because there is more mention there.
To be perfectly honest, for me to give my educated opinion on the matter, it would take more research than what I’ve done to compile this article. Do I think that they should do this? Of course, not. Do I think they can? I doubt it, but I’m not sure. But even if they did this, would it change anything? No. Abortion is already in the hands of the states. Roe isn’t law. It never was. It was always an opinion.
Overall, here’s my tweet that shows my opinion:
So in order to punish SCOTUS from denying itself the power to determine abortion laws for the whole country, you're going to… deny SCOTUS the power to determine abortion laws for the whole country.
Got it.
